RADAR TANGSEL RATAS –Mahkamah Agung dan Kejaksaan Agung (Kejagung) belum satu frekuensi dalam menangani perkara penyalahgunaan narkotika. Demikian salah satu rekomendasi dari hasil penelitian yang dilakukan LBH Keadilan bertajuk “Menyoal Disparitas Putusan Perkara Narkotika”.
Menurut Direktur LBH Keadilan, Yeliza Umami, diperlukan kesepakatan lintas unsur sistem peradilan pidana dalam menangani perkara penyalahgunaan narkotika. “MA harus juga mengajak Kejaksaan Agung sebagai dominus litis dalam perkara pidana untuk duduk bersama dalam mencari kesepahaman penanganan perkara penyalahgunaan narkotika,” ungkap Yeliza, kepada awak redaksi Kantor Berita ratas.id RADAR TANGSEL.
Dalam rilisnya, Sabtu, 18 Mei 2024, penelitian yang dinahkodai Halimah Humayrah Tuanaya ini juga merekomendasikan agar Dewan Perwakilan Rakyat (DPR) melakukan revisi Undang-undang, Nomor 35, Tahun 2009 tentang Narkotika (UU Narkotika). Khususnya, Pasal 111, 112 dan 127 yang penerapannya menimbulkan permasalahan.
Penerapan oleh hakim atas Pasal 111, 112 UU Narkotika dalam perkara yang tidak mencantumkan Pasal 127 UU Narkotika dalam dakwaannya, lanjutnya, masih belum satu suara. “Terdapat disparitas dalam putusan-putusannya,” tandas Yeliza.
Penelitian yang dilakukan dan dikomandoi oleh Dosen Fakultas Hukum Universitas Pamulang, Halimah Humayrah Tuanaya ini setidaknya telah mencatat empat jenis Putusan Mahkamah Agung dalam menerapkan Pasal 127 Undang-undang Narkotika. Apa saja empat jenis putusan MA tersebut?
Pertama, majelis hakim tetap mendasarkan pada surat dakwaan dan ketentuan pidana yang menjadi dasar dakwaan walaupun berakibat bebasnya terdakwa. Kedua, majelis hakim tetap mendasarkan pada surat dakwaan dan ketentuan pidana yang menjadi dasar dakwaan, dengan berakibat pada penjatuhan hukuman yang lebih berat dari yang seharusnya karena adanya ancaman pidana minimum khusus.
Ketiga, majelis hakim tetap mendasarkan pada surat dakwaan dan ketentuan pidana yang menjadi dasar dakwaan. Tetapi, dengan menjatuhkan pidana di bawah ancaman pidana minimum khusus dari delik yang didakwakan.
Keempat, majelis hakim menjatuhkan putusan berdasarkan ketentuan pidana yang tidak didakwakan penuntut umum. Sikap Mahkamah Agung dalam menghasilkan putusan pada perkara penyalahgunaan narkotika yang tidak sesuai dengan dakwaan jaksa sangat bertentangan dengan asas kepastian hukum, paparnya.
Timbulkan Kebingungan di Masyarakat
Disparitas putusan Mahkamah Agung akan menimbulkan kebingungan di masyarakat, urai Yeliza. “Pelaku penyalahgunaan narkotika dihadapkan pada kebingungan ketika mengajukan pembelaan atas perbuatan penyalahgunaan narkotika yang sama sekali tidak didakwakan dalam berkas perkaranya,” tegasnya.
Di sisi lain, terang dia, hasil rapat pleno kamar pidana tahun 2015 yang dituangkan dalam Surat Edaran Mahkamah Agung, Nomor 03, Tahun 2015 juga bertentangan dengan prinsip kepastian hukum. “Yakni, mengabaikan ketentuan Pasal 191, Ayat (1) KUHAP,” pungkasnya. (AGS)
